A. Right of Withdrawal

Consumers are entitled to a right of withdrawal in accordance with the following provisions. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.

1. Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the last goods.

Notwithstanding this, in the case of a contract for the regular delivery of goods over a specified period, the withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the first goods.

by means of a clear declaration (e.g., by e-mail or letter) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but this is not mandatory.

To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

2. Consequences of Withdrawal

If you withdraw from this contract, we must repay to you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which the notification of your withdrawal from this contract was received by us.

For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.

We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to the following address without delay and in any case no later than fourteen days from the day on which you inform us of the withdrawal from this contract:

The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for checking their nature, properties and functioning.

3. Exclusion or early expiry of the right of withdrawal

The right of withdrawal does not apply to contracts for the delivery of goods that can spoil quickly or whose expiry date would be quickly exceeded.

The right of withdrawal expires prematurely for contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

The right of withdrawal expires prematurely for contracts for the delivery of goods if they have been inseparably mixed with other goods after delivery due to their nature.

Since our products are food, the right of withdrawal expires prematurely as soon as the sealed packaging has been opened after delivery. Unopened and originally sealed products can be withdrawn within the framework of the legal provisions.

The right of withdrawal does not apply to consumers who are not members of a Member State of the European Union at the time of concluding the contract and whose sole residence and delivery address at the time of concluding the contract are outside the European Union.

4. Transport Damage and Incorrect Deliveries

Please check the goods immediately upon receipt for completeness, obvious defects, and transport damage.

Should transport damage or incorrect deliveries occur, please inform hello@purplespices.com immediately so that the matter can be clarified as quickly as possible.

Failure to complain or make contact has no consequences for your statutory warranty rights.

5. Financed Purchase

If you finance this contract through a loan and later withdraw from it, you are no longer bound by the loan agreement either, provided that both contracts form an economic unit. This is particularly to be assumed if we are simultaneously your lender or if your lender makes use of our cooperation with regard to the financing. If the loan has already accrued to us when the withdrawal becomes effective or when the goods are returned, your lender shall, in relation to you, assume our rights and obligations from the financed contract with regard to the legal consequences of the withdrawal. If you wish to avoid a contractual obligation as far as possible, make use of your right of withdrawal and also withdraw from the loan agreement if you are also entitled to a right of withdrawal for it.

6. Exclusion of Further Returns

Excluded from return according to § 312g Abs. 2 BGB are:

• opened or unsealed foodstuffs,
• individually manufactured or personalised products,
• gift vouchers, if these have already been redeemed or their return is not legally provided for.
